MEMORANDUM AND ORDER by Senior Judge Charles R. Simpson, III on 9/5/24: IT IS ORDERED that the claims set forth in the complaint against all Defendants are DISMISSED pursuant to 28 U.S.C. 1915A(b)(1) for failure to state a claim upon which relief may be granted. IT IS FURTHER ORDERED that no later than 10/5/2024, Plaintiff may file an amended complaint in which he names as Defendants the individuals who were deliberately indifferent to his serious medical needs and makes specific allegations against each Defendant. If Plaintiff does not know the identity of any Defendant, he may identify that Defendant as John Doe or Jane Doe and specifically allege facts describing what each unknown/Doe Defendant did or failed to do that showed deliberate indifference to his serious medical needs. If Plaintiff files an amended complaint by 10/5/2024, the Court will review it pursuant to 1915A. If Plaintiff fails to file an amended complaint by that date, the Court will dismiss this action for the reasons stated herein. Clerk of Court is DIRECTED to terminate Defendants Eagles and Denny as parties to this action. The Clerk of Court is further DIRECTED to send Plaintiff a 1983 prisoner complaint form with this case number and the words Amended Complaint written in the caption. cc: Plaintiff(pro se w/1983 Form), Defendants, HCA (DJT)
