Filing 59 ORDER AND REASONS re 31 MOTION for Summary Judgment and 30 MOTION in Limine to Exclude Testimony, Evidence and Argument; ORDERED that defendants' motion for partial summary judgment is GRANTED. Except with respect to Schexnay der and Thomas, plaintiff's claims against defendants in their individual capacities are DISMISSED WITH PREJUDICE. Except with respect to Sheriff Tregre, plaintiff's claims against defendants in their official capacities are also DISMISSE D WITH PREJUDICE. The Court notes that plaintiff's state law claims against Sheriff Tregre premised on vicarious liability also remain in the lawsuit. FURTHER ORDERED that defendants' motion in limine is GRANTED IN PART. The motion in limi ne is GRANTED with respect to admission of the entire report, although relevant portions of the transcripts of interviews with Schexnayder and Thomas may be admitted provided that a proper foundation for their admission is laid at trial.
