ORDER: IT IS HEREBY ORDERED that Defendant Board of Supervisors for the University of Louisiana System's 22 Motion for Summary Judgment is GRANTED IN PART and DENIED IN PART. The motion is granted in part to the extent that the Court treats it as a motion to dismiss for lack of subject matter jurisdiction and dismisses Plaintiff's state law negligence claim without prejudice pursuant to Defendant's Eleventh Amendment immunity defense. The motion is denied in part to the extent that there are disputed issues of material fact precluding summary judgment on Plaintiff's Title IX claim. Signed by Judge Nannette Jolivette Brown on 8/8/2017. (mmv)
