ORDER & REASONS that Defendant's 39 Motion for Partial Summary Judgment is GRANTED. IT IS FURTHER ORDERED that Plaintiff's 47 Motion for Summary Judgment is DENIED. IT IS FURTHER ORDERED that Plaintiff may file an opposition to the Courts Rule 56(f)(3) sua sponte notice within 30 days from the issuance of this Order. If Plaintiff files such a brief, Defendant may file a reply within 10 days.
