ORDER GRANTING #2 Motion to Deposit Funds into the Registry of the Court and for Release of Cargo from Arrest or Seizure. IT IS HEREBY ORDERED that the amount of SEVENTY THREE THOUSAND, FIVE HUNDRED AND NO/100 ($73,500.00) DOLLARS is sufficient security for MRC Denizcilik's lien against Cornerstone's cargo and is conditioned to answer any arbitral award, the judgement of the Court or of any appellate court. The Clerk shall accept and deposit into the Court's Registry the security in the foregoing amount and shall also issue to counsel for Cornerstone a receipt therefore. IT IS FURTHER ORDERED that upon the deposit of the Security with the Clerk of Court, the Cornerstone cargo on board or discharged from the M/T ALEYNA MERCAN in Yalova, Turkey, shall be delivered to the respective consignees free and clear of any liens that may have been asserted by MRC Denizcilik. IT IS FURTHER ORDERED that the Cornerstone cargo will not be subject to further arrest, attachment or seizure by MRC Denizcilik for claims or debts asserted by MRC Denizcilik against Cornerstone arising from the shipment referred to in the January 28 and 29, 2021, correspondence issued on behalf of MRC Denizcilik to Cornerstone. IT IS FURTHER ORDERED that all other rights and defenses of Cornerstone and MRC Denizcilik are specifically preserved with the full reservation of rights, claims and defenses available to Cornerstone and MRC Denizcilik.
