RULING: Because Defendants have failed to establish that there are no genuine issues of material fact as to whether Haven breached its warranty against defects in workmanship, the Court DENIES Defendants Motion for Summary Judgment (doc. 41), in part . However, because South Carolina law governs the parties dispute, Plaintiffs cannot establish a right to relief based on Louisiana redhibition law or the NHWA, and so the Court GRANTS 41 Defendants Motion for Summary Judgment in part.
