RULING & Order granting in part 31 Motion to Compel Pltf's Deposition in that pltf, Sherman Augustine, shall personally appear for and participate in a deposition in this matter by 8/22/2011, failing which he will face sanctions imposed by the Court, and Denied in Part, with respect to dft's present request for sanctions. IT IS FURTHER ORDERED that, to allow for pltf's deposition, Dfts' 32 Motion to Extend Dispositive Motion Deadline is hereby GRANTED and the dispositive motion filing deadline is extended to 9/30/2011.. OPINION Adopting 7 Report and Recommendations of the U.S. Magistrate Judge regarding the 2 Motion to Remand filed by Sherman J. Augustine. The Court finds that the Motion to Remand is DENIED. However, the Court in the exercise of the discretion provided to the Court under 28 USC 1367 refuses to hear the state law claims. Therefore, the state court claims are remanded to state court.
