NOTICE AND ORDER: Plaintiff Jessica Carline filed her #1 Original Complaint for Product Liability on August 12, 2024, which does not specifically allege a basis for this Court's subject matter jurisdiction but diversity of citizenship under 28 U.S.C. 1332 potentially exists based on the allegations. The Complaint affirmatively alleges an amount in controversy in excess of $75,000, exclusive of interest and costs. R. Doc. 1, p. 8. The Complaint also adequately alleges the citizenship of Defendant Samsung Electronics America, Inc., a New York corporation with its principal place of business in New Jersey. However, the Complaint does not adequately allege the citizenship of Plaintiff, as it only alleges Plaintiff's residency. The citizenship of an individual, such as Plaintiff, is determined by the individual's domicile, not residency. Mas v. Perry, 489 F.2d 1396, 1399 (5th Cir. 1974). Accordingly, IT IS ORDERED that by no later than August 20, 2024, Plaintiff shall file a motion for leave to file a comprehensive amended Complaint, that contains all of Plaintiff's allegations as amended, which properly alleges the citizenship of all parties.
