ORDER: After due consideration of the record the Court finds the 33 Agreed Motion to Consolidate should be GRANTED. It is further, ORDERED AND ADJUDGED that 5:16-cv-00681, be consolidated into the first-filed matter, 5:16-cv-00448. It is further, ORDERED AND ADJUDGED all future pleadings be filed under the first-filed, instant matter styled 5:16-cv-00448. It is further, ORDERED AND ADJUDGED, Plaintiff has waived his right to object to the Report and Recommendation of the Magistrate Judge. Ac cordingly, this Court adopts the 30 Report and Recommendation without objection.
