MEMORANDUM RULING: The Court lacks subject-matter jurisdiction over the claims against the StateDefendants, IT IS ORDERED those claims are SEVERED and REMANDED to the 2nd JDC. The 28 Motion to Dismiss is DENIED AS MOOT; 30 Motion to Dismiss is G RANTED IN PART and DENIED IN PART. Plaintiff seeks monetary damages only, the motion is GRANTED to the extent it seeks dismissal of claims against Goodwin in his official capacity. Also GRANTED as to Plaintiff's § 1983 claims Goodwin was d eliberately indifferent in light of his subjective awareness of Goudeau's risk of suicide and Goodwin is liable of Goudeau's death was due to foul play or criminal violation. These claims are DISMISSED WITH PREJUDICE. Goodwin's motion is DENIED as to Plaintiffs § 1983 claim that Goodwin established an insufficient suicide prevention policy and as to Plaintiff's state-law tort claims.
