Doc s. 35 and 40) be GRANTED IN PART AND DENIED IN PART as follows: 1) All of plaintiffs federal law claims be DISMISSED WITH PREJUDICE for failure to state a claim; 2) All of plaintiffs state law claims be DISMISSED WITHOUT PREJUDICE to their reassertion in an appropriate state court.
