JUDGMENT regarding 35 Report and Recommendations adopts the findings and conclusions therein as its own. Accordingly, IT IS THEREFORE ORDERED, ADJUDGED, AND DECREED that, consistent with the report and recommendation, 18 & 32 Motions to Dismi ss for Failure to State a Claim are GRANTED IN PART and DENIED IN PART. Dismissal of plaintiff's complaint under FRCP 12(b)(1) for lack of jurisdiction is DENIED. Dismissal of plainitff's claims under FRCP 12(b)(6) for failure to state a claim is GRANTED.
