This Order shall be STAYED for 14 days from the date of issuance. Any appeal to the District Judge must be filed within 14 days from the date of this Order. If an appeal is taken to the District Judge, this Order shall remain stayed until the appeal is decided. If no timely appeal is filed, the clerk shall transfer the action forthwith. October 13, 2015 Filing 71 MINUTE ENTRY: The Court is in receipt of correspondence from counsel for plaintiff, Nexen Petroleum USA, Inc., dated October 9, 2015, wherein counsel requests the Court hold a telephone status conference. In the correspondence, counsel notes its disagreement with a Ruling of the Magistrate Judge staying discovery, and states before filing any appeal of that Ruling, it would like this Court to hold a status conference to advise how it would prefer this matter to proceed. Following receipt of the correspondence, the Court spoke with the Magistrate Judge, who advised a Ruling on the motion to transfer should issue next week. (However, given the large volume of briefing on the motion to transfer, this Court is of the opinion issuance of a Ruling could require a bit more time.) In light of the pending Ruling on the motion to transfer venue, and as there is no indication the requested discovery would impact the Ruling on the motion to transfer venue, no status conference will be scheduled at this time. The parties may file any appeal of the Magistrate Judges rulings they believe warranted. Once the Ruling on the motion to transfer venue issues, plaintiff may re-urge its request for a telephone status conference at that time, should plaintiff be of the opinion a status conference is warranted.
