ORDER: IT IS ORDERED that, to the extent that the 31 Motion for Summary Judgment on qualified immunity remains pending with regard to the claims asserted by plaintiff Jerald Stansbury, the motion is DENIED without prejudice to the defendants' right to reassert the motion, if necessary or appropriate, following the resolution of the state-law criminal charges currently pending against Mr. Stansbury. RULE 7(a) Heightened Pleading Review. Although the court may later determine the facts in favor of the defendants, the sole issue presented here is whether the plaintiff has satisfied the heightened pleading requirement of Shultea, which the undersigned concludes he has done.
