Kologik's Motion for Summary Judgment (dkt. no. 301 ) is GRANTED in part as to no invali dity and DENIED in part as to infringement of the '965 Patent. Kologik's motion for sanctions (dkt. no. 301 ) is also DENIED. The defendants' Motion for Summary Judgment of Noninfringement (dkt. no. 305 ) is GRANTED.
