Filing 7 Judge William G. Young: ELECTRONIC ORDER entered re #2 Motion for Leave to Proceed in forma pauperis.Plaintiff Bahig Bishay's ("Bishay") motion to proceed in forma pauperis (ECF No. #2 ) is hereby ALLOWED. Because plaintiff is proceeding in forma pauperis, this action is subject to screening pursuant to 28 U.S.C. 1915(e), and is hereby DISMISSED sua sponte for lack of subject matter jurisdiction. This Court is without jurisdiction to review judgments of the First Circuit Court of Appeals. Rather, only the Supreme Court is authorized to do so. See 28 U.S.C. 1254. Here, Bishay essentially disagrees with the First Circuit's March 27, 2019 judgment, dismissing as untimely Bishay's appeal of the district court's November 13, 2017 dismissal with prejudice of the action styled Bishay v. Cornetta et al., Civil Action No. 17-11591-ADB, ECF Nos. 21 and 22. Bishay did not attempt to appeal to the Supreme Court. Even if this Court had jurisdiction, "[t]o the extent that the complaint asserts claims against judicial officers based on [Bishay's] dissatisfaction with the manner in which his cases have been decided, such claims are barred because of the doctrine of judicial immunity." Johnson v. U.S. Judges, No. CIV.A. 14-11273-DPW, 2014 WL 3109962, at *2 (D. Mass. July 7, 2014). And, even if the Court had jurisdiction over the remaining defendants, there are no plausibly pleaded allegations supporting a violation of Bishay's federal rights. The Clerk shall issue a separate order of dismissal. (Paine, Matthew) |
