September 19, 2019 Filing 7 Chief Judge Patti B. Saris: MEMORANDUM AND ORDER entered. 1.The motion for leave to proceed in forma pauperis [ECF No. 4] is GRANTED. Pursuant to 28 U.S.C. 1915(b)(1), an initial partial filing fee of $12.74 is assessed. The remaining $337.26 shall be collected in accordance with 28 U.S.C. 1915(b)(2). The Clerk shall send a copy of this order to the treasurer of the institution with custody of the plaintiff. 2.The motion for an emergency injunction [ECF No. 2] is DENIED. 3.The motion for appointment of counsel [ECF No. 3] is GRANTED and this matter is referred to the Court's Pro Bono Coordinator. Plaintiff shall continue to proceed pro se and represent himself until pro bono counsel is appointed. 4.The Clerk shall issue summonses for service of the complaint on defendants Turco, Silva, Kenneway and Bennett. 5.The claims against the remaining defendants are DISMISSED sua sponte, without prejudice to plaintiff seeking reconsideration within 42 days of the date of this Memorandum and Order, including underlying factual support and legal authority for the claims against any of the remaining defendants. 6.Because the plaintiff is proceeding in forma pauperis, he may elect to have service completed by the United States Marshals Service (USMS). If the plaintiff chooses to have service completed by the USMS, he shall provide the USMS with all papers for service and a completed USM-285 form for each party to be served. The USMS shall complete service as directed by the plaintiff with all costs of service to be advanced by the United States. The Clerk shall provide the plaintiff blank USM-285 forms and instructions for service by the USMS. 7.The defendants, if properly served, are required to respond to the complaint. See 42 U.S.C. 1997e(g)(2). 8.Notwithstanding Fed. R. Civ. P. 4(m) and Local Rule 4.1, the plaintiff shall have 90 days from the date of this Order to complete service of the complaint on defendants Turco, Silva, Kenneway and Bennett.(PSSA, 4)
