| Filing 6 Judge Nathaniel M. Gorton: ELECTRONIC ORDER entered deferring action on #4 Motion for Leave to Proceed in forma pauperis filed by plaintiff Tariff Sharif Bey (a/k/a Aaron Lamon Johnson). The deadline for filing a copy of plaintiffs prison account statement (MSA 2010451) is extended until November 19, 2021. In order to facilitate plaintiffs request for a copy of his prison account statement, the Clerk shall send a copy of this Electronic Order and the 10/12/21 Procedural Order [ECF No. 3] to the Treasurers Office at the Middleton House of Correction. Based on the information contained in the prison account statement, the Court will direct the treasurer to withdraw an initial payment from the plaintiffs account, followed by payments on a monthly basis until the entire $350.00 filing fee is paid in full. See 28 U.S.C. 1915(b)(1)-(2). Even if the action is dismissed upon a preliminary screening, see 28 U.S.C. 1915(e)(2), 1915A, the plaintiff remains obligated to pay the fee. The Court requests that the Treasurers Office provide a copy of plaintiffs prison account statement including the plaintiffs average monthly deposits for the six-month period preceding the date this action was filed (9/14/21), as well as the average monthly balance for that same period.(PSSA, 4) |
