Filing 6 Judge Richard G. Stearns: ELECTRONIC ORDER entered. ORDER DISMISSING CASE. On June 5, 2023, plaintiff Joel Jeannite was ordered to file an amended complaint by June 19, 2023. See Order, Doc. No. 4. On June 16, 2023, the order mailed to Jeannite was returned as undeliverable. See Doc. No. 5. Pursuant to Local Rule 83.5.5(h) "[a]ny notice sent by the clerk... to a pro se party shall be deemed delivered and properly served if sent to the most recent address or e-mail address provided by the pro se party." Nothing further has been filed by Jeannite in this action. Accordingly, this action is DISMISSED without prejudice for failure to comply with the Court's June 5, 2023 Order. The Clerk is directed to enter a separate order of dismissal without prejudice. A review of the docket indicates that Jeannite has filed numerous cases in this district, and is informed that he often appears at the Clerks Office to conduct business. The Court directs the Clerk to mail a copy of this order to the address of record, and also hold a copy of the order to provide to Jeannite in the event he appears in person at the Clerks Office until July 7, 2023, so that he is made aware that his address in this action (1756 Dorchester Ave., Dorchester, MA 02124) was not sufficient, so that he may correct his address with the Clerks Office as is his obligation under the Local Rules of this Court. See Local Rule 83.5.5(h) ("Every party appearing pro se shall inform the clerk and all parties in writing of any change of name, address, telephone number, or e-mail address within 14 days of the change. It is the responsibility of the pro se party to notify the clerk and the parties of any change.").(PSSA, 4) |
