Judge Mark G. Mastroianni: MEMORANDUM AND ORDER entered. As follows: For the reasons stated, the courts adopts the recommendations in the R&R (Dkt. No. 33 ). Upon de novo review, Doerpholzs Motion to Dismiss (Dkt. No. 24 ), to which no objections w ere filed, is DENIED in its entirety. Orrs Motion to Dismiss (Dkt. No. 18 ) is DENIED with respect to Plaintiffs claim for IIED and ALLOWED as to Plaintiffs MCRA and § 1983 claims against Orr. Finally, the Light Boards Motion to Dismiss Count VI (Dkt.
