Filing 9 Motion for Exemption from PACER Fees. Requests for an exemption from fees will be directed to the Chief Judge of the Court for review. If granted, the exemption is limited only to the customer's access to the records from the court that issued the exemption order. If the PACER account is used to access records from another court, that usage would be billed to the customer at the rate set forth in the EPA Fee Schedule filed by Steven Frank Bourassa.(Burgos, Sandra) |
Filing 8 Judge Indira Talwani: ELECTRONIC ORDER: Before the court is Appellee's Motion to Dismiss Appeal #4 for failure to file and serve the designation of record on appeal and a statement of issues presented as required by Fed. R. Bankr. P. 8009 and Appellant Steven F. Bourassa's Clarification of Due Dates Regarding Debtors' Filing of Appeal and Designation of Record and Statement of Issues on Appeal #7 which this court treats as a response to the court's Order to Show Cause #6 . Appellant's assertion that the April 10, 2020, Certificate of Default #5 issued by the U.S. Bankruptcy Court was premature and has no force and effect is incorrect, where he sought no stay of the deadline. Nor is Appellant's contention that he did not receive the April 10, 2020, Certificate of Default until May 8, 2020, material, where Appellant apparently did not pick up his mail until May 8, 2020. Accordingly, Appellant is due no relief from the deadline as a matter of right. As a courtesy to Appellant in light of his mistaken belief that his then-pending motion for leave to appeal in forma pauperis allowed him to ignore other deadlines, and in the interest of resolving matters on the merits, the court as a courtesy extends Appellant's time for filing a designation of items to include in the record on appeal and statement of issues presented to May 22, 2020. The court does not anticipate granting a further extension of this deadline. Appellee's Motion to Dismiss Appeal #4 is denied without prejudice to refiling if Appellant Steven F. Bourassa's required filing is not made by May 22, 2020. (Kelly, Danielle) |
