MEMORANDUM OPINION AND ORDER adopting Magistrate Judge's 5 Report and Recommendation, denying petitioner's 2 Application to Proceed In Forma Pauperis in District Court filed by Odell DePriest Crawf ord. This action is dismissed without prejudice for lack of jurisdiction. IT IS FURTHER HEREBY ORDERED that pursuant to 28 U.S.C. § 2253(c) the Court grants petitioner a Certificate of Appealabilit y with respect to the limited issue of whether Crawford's 28 U.S.C. § 2254 claims arising from evidence previously concealed by the state are subject to AEDPA's preauthorization requirement under 28 U.S.C. § 2244(b)(3).
