October 13, 2011 Opinion or Order Filing 77 MEMORANDUM re: 55 MOTION for Summary Judgment filed by Defendant Siegel-Robert, Inc. - In sum, defendant SRG has met its burden of showing that "there is no genuine issue as to material fact" and that it is "entitled to judgment as a matter of law." Poller, 368 U.S. at 467. The burden thus shifted to plaintiff, who was required to set forth specific facts showing that there is sufficient evidence in its favor to allow a jury to return a verdict for it. Anderson, 477 U.S. at 249; Celotex Corp., 477 U.S. at 324. Here, plaintiff did not contest any of the facts set forth by defendant SRG, nor did plaintiff even argue that SRG was not entitled to summary judgment. Moreover, plaintiff's own testimony establishes that no duty was owed to plaintiff by defendant SRG, and that SRG is entitled to summary judgment as a matter of law. Signed by Honorable Stephen N.
