MEMORANDUM AND ORDER..IT IS HEREBY ORDERED that the Clerk shall issue process or cause process to be issued on the amended complaint as to defendants Brandon Lowe and Wade Dare, in their individual capacities. IT IS FURTHER ORDERED that defendants Br andon Lowe and Wade Dare, in their individual capacities, shall file a responsive pleading directed to plaintiff's Fourth and Fourteenth Amendment claims, as set forth in the amended complaint, pursuant to Rule 12 of the Federal Rules of Civil P rocedure. IT IS FURTHER ORDERED that plaintiff's Eighth Amendment claims against defendants Brandon Lowe and Wade Dare, as set forth in the amended complaint [Doc. #9], are DISMISSED, without prejudice, pursuant to 28 U.S.C. § 1915(e)(2)(B).
