OPINION, MEMORANDUM AND ORDER: IT IS HEREBY ORDERED that petitioner shall, no later than thirty (30) days from the date of this order, show cause why the petition for writ of habeas corpus should not be dismissed without prejudice for failure to exha ust state remedies. IT IS FURTHER ORDERED that petitioner's motion for leave to proceed in forma pauperis [Doc. 2 ] is GRANTED. IT IS FURTHER ORDERED that the Clerk shall substitute Penny Milburn for the State of Missouri as respondent in this action.
