MEMORANDUM AND ORDER: IT IS HEREBY ORDERED that Defendant's Motion to Dismiss or Transfer [ECF No. 6 ] is DENIED in part and GRANTED in part. The case is transferred to the United States District Court of Colorado. That part of the motion req uesting dismissal of Plaintiff's claims is denied without prejudice pending transfer of the case to the District of Colorado. IT IS FURTHER ORDERED that the Clerk of Court shall transfer this action to the United States District Court of Colorado pursuant to 28 U.S.C. § 1404(a). Signed by District Judge E.
