Switzer are dismissed from this action. IT IS FURTHE R ORDERED that defendants motion to dismiss # 42 isgranted, and defendant Missouri State Highway Patrol is dismissed from thisaction, and Count IV against defendant Philip D. Hoffman is dismissed, andCounts V, VI, and VII against defendant Philip Ho ffman in his official capacityonly are dismissed, but Counts V, VI, and VII against defendant Hoffman in hisindividual capacity remain pending.
