MEMORANDUM AND ORDER IT IS HEREBY ORDERED that Defendants motion to dismiss (Doc. No. 50) is GRANTED as follows: 1. Plaintiffs claim for individual discrimination against Defendant Commerce Bank is DISMISSED without prejudice. Plaintiff shall have un til November 21, 2014, to amend his complaint to properly state a claim against the bank for individual discrimination under the ECOA. 2. Plaintiffs claim for red-lining, and Plaintiffs claims against Defendants Murphy and Bailey in their individual capacities, are DISMISSED withprejudice. IT IS FURTHER ORDERED that Defendants motion for a more definitestatement (Doc. No. 33), which was directed to Plaintiffs original complaint, is DENIED as moot.
