IT IS FURTHER O RDERED that CMI's motion for summary judgment (ECF No. 46 ) is GRANTED as to liability and DENIED as to damages. IT IS FINALLY ORDERED that the Court shall hold a final pretrial conference at 10:00 a.m. on October 19, 2017. The parties are re minded that this matter is set for a jury trial at 9:00 a.m. on October 23, 2017. (ECF No. 79 ).
