Filing 11 OPINION, MEMORANDUM AND ORDER - IT IS HEREBY ORDERED that petitioner's motion to proceed in forma pauperis [Doc. # 3 ] is GRANTED. IT IS FURTHER ORDERED that petitioner=s application for writ of habeas corpus pursuant to 28 U.S.C. § 2241 is DENIED AND DISMISSED for failure to exhaust state court remedies. IT IS FURTHER ORDERED that petitioner's supplemental filings to his petition [Doc. # 6 , # 7 , # 8 and # 10 ] are STRICKEN as improperly filed. IT IS FURTHER ORDERED that to t he extent petitioner's application for writ of habeas corpus includes any claims brought pursuant to 42 U.S.C. § 1983, those claims are DISMISSED without prejudice so that petitioner may refile them in a civil rights action at a later time. IT IS FURTHER ORDERED that the Court will not issue a certificate of appealability. A separate Judgment shall accompany this Memorandum and Order.
