Filing 90 ORDER granting in part and denying in part Plts' 75 Motion for Summary Judgment: 1. MCA 13-35-225(3)(a) is unconstitutionally vague; 2. MCA 13-37-131 is unconstitutionally vague; and 3. MCA 13-35-227 is unconstitutional to the extent it p rohibits a corporation from making a contribution to a political committee that the committee than uses for independent expenditures in support of or opposition to a candidate. The dfts are PERMANENTLY ENJOINED from enforcing each of these three pro visions. Plts' motion is DENIED in all other respects. The Court further grants in part and denies in part Dfts' 78 Motion for Partial Summary Judgment: MCA 13-35-227 is constitutional to the extent it prohibits a corporation from mak ing direct or indirect contributions to candidates or political parties. Dfts' motion is denied in all other respects. It is further ordered the 2/24/12 preliminary injunction 66 is dissolved. It is further ordered that this order and permanent injunction is the final judgment as to the issues addressed herein. Let this judgment enter.
