MEMORANDUM AND ORDER - Defendants' motion to dismiss pursuant to Fed. R. Civ. P. 12(b)(6) (Filing 22 ) is granted in part and denied in part, as specified below. As to Plaintiff's 42 U.S.C. § 1983 governmental "policy" clai m against the City of Beatrice, Plaintiff is granted leave to amend his complaint to allege facts demonstrating that, under Nebraska law, Mayor Schuster possessed final policy making authority over City of Beatrice condemnation procedures. Plainti ff's amended complaint shall be filed on or before October 27, 2014, and shall clearly identify the proposed amendments and delete all references to claims that have been dismissed pursuant to paragraph 1(a) above. Failure to file such complaint shall result in dismissal of Plaintiffs 42 U.S.C. § 1983 governmental "policy" claim against the City of Beatrice without further notice.
