November 6, 2019 Opinion or Order Filing 77 MEMORANDUM AND ORDER NUNC PRO TUNC: Defendant Black's claim of priority to the remaining $731.17 plus interest is dismissed with prejudice; Defendant Swanson is entitled to priority as to the remaining funds; The Clerk of Court shall pr epare a check on the funds deposited in the Court Registry in the amount of $731.17 in principal plus any accrued interest, made payable to Christine L. Swanson; Defendant Swanson is ordered to complete an Internal Revenue Service Form W-9 and submit it via e-mail to the Clerk of Court. Upon receipt of such Form W-9, the Clerk of Court shall mail said funds to Christine L. Swanson, PO Box 172, Waukee, Iowa 50263. The Court will enter a separate judgment. Ordered by Judge Brian C. October 23, 2019 Opinion or Order Filing 71 ORDER that on or before October 31, 2019, each party shall deliver a copy of the exhibits they intend to use at trial to the Clerk's office of the federal court in Omaha, Nebraska. Upon receipt, the clerk's office shall promptly deliver the documents to Judge Buescher's chambers. The failure to timely attend the trial as scheduled will result in dismissal, with prejudice, of the non-attending party's claim to the $731.17 currently deposited with the court. If nei ther party timely attends the trial, the $731.17 will be divided in half, with equal amounts (to the extent possible) then distributed to each of Defendants Swanson and Black. Defendant Black may also file such a statement on or before March 19, 2019.
