MEMORANDUM AND ORDER - Upon initial review of the Petition for Writ of Habeas Corpus 1 , the court preliminarily determines that the following claims are potentially cognizable in federal court: Claims One through Three as described in this Memorand um and Order. Petitioner's Motion for Appointment of Counsel 3 is denied without prejudice to reassertion. The Clerk of the court is directed to mail copies of this Memorandum and Order and the Petition for Writ of Habeas Corpus 1 to the R espondents and the Nebraska Attorney General by regular first-class mail. By March 19, 2008, Respondents shall file a motion for summary judgment or an answer. The Clerk of the court is directed to set a pro se case management deadline in this case using the following text: March 19, 2008: deadline for Respondents to file answer or motion for summary judgment. If Respondents elect to file a motion for summary judgment, theprocedures listed in this Memorandum and Order shall be followed by Resp ondents and Petitioner. If Respondents file an answer, the procedures listed in this order shall be followed by Respondents and Petitioner. No discovery shall be undertaken without leave of the court. See Rule 6 ofthe Rules Governing Section 2254 C ases in the United States District Courts.
