Filing 12 MEMORANDUM AND ORDER regarding 11 Motion to Dismiss. Slupkowski's February 5, 2009 Motions (Case No. 8:08CV471, filing no. 11; Case No. 8:08CV472, filing no. 11 ), which the court construes as motions filed pursuant to Federal Rule of Civil P rocedure 41 are granted. These matters are dismissed without prejudice. Slupkowski's request to refund the filing fees in these two matters is denied. None of the filing fees paid in either case shall be refunded. Filing 7 MEMORANDUM AND ORDER granting 6 Motion to consolidate cases. Slupkowski is permitted to consolidate these matters. No later than January 30, 2009, Slupkowski shall file an amended complaint in Case No. 8:08CV472. The amended complaint shall contai n all of Slupkowski's claims, including those presented in Case No. 8:08CV471. Any claims not contained in the amended complaint will be deemed abandoned. In the event that Slupkowski files an amended complaint in accordance with this Memorandum and Order, Case No. 8:08CV471 will be dismissed. However, the filing fee paid in Case No. 8:08CV471 will not be refunded.
