MEMORANDUM AND ORDER regarding Notice of Filing Bankruptcy 1 . The court finds the bankruptcy courts grant of summary judgment is supported by the law and the facts and, consequently, the court will affirm the bankruptcy judge. THEREFORE, IT IS ORDE RED: 1. The interlocutory appeal, Filing No. 1 , is overruled. 2. The ruling of the bankruptcy judge granting summary judgment against the plaintiffs and in favor of the defendants is affirmed. 3. This case is remanded to the bankruptcy court for further disposition. Ordered by Chief Judge Joseph F. Bataillon. (JAB)
