MEMORANDUM AND ORDER ON DEFENDANTS' MOTION TO DISMISS - The defendants' motion to dismiss, ECF No. 5 , is granted in part. All claims against Defendant University of Nebraska Omaha are dismissed. Counts III and IV are dismissed in their entirety. Count II is dismissed insofar as the remaining defendants are sued in their official capacities.
