ORDER upon notice of settlement given to the magistrate judge on September 19, 2014. On or before November 3, 2014, the parties shall electronically file a joint stipulation for dismissal (or other dispositive stipulation) and shall submit to the H onorable Joseph F. Bataillon, at bataillon@ned.uscourts.gov, a draft order which will fully dispose of the case. If the case is being dismissed, the stipulation shall comply with Fed. R. Civ. P. 41(a) and shall state whether the dismissal is with or without prejudice. Absent compliance with this order, this case (including all counterclaims and the like) may be dismissed without further notice. Ground Improvement Engineering's motion to dismiss, Filing No. 55 , is granted in part. Geopier Foundation Company's motion to dismiss, Filing No. 62 , is granted in part. Hawkins Construction Company's motion to strike the reply brief, Filing No. 72 , is denied. The plaintiff is granted 30 days to file an amended complaint relating to its Eleventh Claim for Relief against GIE and Geopier.
