Defendant's motion for summary judgment (Filing 52 ) is granted, and Plaintiff's complaint is dismissed with prejudice. Plaintiff's motion for summary judgment (Filing 56 ) is granted in part and denied in part, as follows: a. The motion is granted with re spect to Count I and Count II of Defendant's counterclaims, and they are dismissed with prejudice. b. Count III and Count IV of Defendants counterclaims are dismissed without prejudice, as moot. c. The motion is denied with respect to Plaintiff's complaint.
