MEMORANDUM AND ORDER that on September 17, 2015, the Court ordered plaintiff to pay the $400.00 filing and administrative fees or file a request for leave to proceed in forma pauperis within 30 days or face dismissal of this action. To date, pla intiff has not paid the fees, submitted a request for leave to proceed in forma pauperis, or taken any other action in this matter. This matter will be dismissed without prejudice because plaintiff failed to prosecute it diligently and failed to comply with this Court's orders. MEMORANDUM AND ORDER that the Plaintiff is directed to submit the $400.00 fees to the clerks office or submit a request to proceed in forma pauperis within 30 days. Failure to take either action will result in dismissal of this matter without fu rther notice. The clerk of the court is directed to send to plaintiff the Form AO240 (Application to Proceed Without Prepayment of Fees and Affidavit), and also term the motion event appearing at Filing Number 1, Part 2 of 2.
