The court's memorandum and order entered on January 23, 2018 (Filing No. 9 ), is set aside and vacated. 2. Plaintiff's motion for leave to proceed in forma pauperis (Filin g No. 5 )is denied. 3. Plaintiff has until March 12, 2018, to either show cause why this case should not be dismissed pursuant to 28 U.S.C. §1915(g) or pay the full $400.00 filing and administrative fees. In the absence of either acti on by Plaintiff, this matter will be dismissed without further notice. 4. The clerk of the court is directed to set a pro se case management deadline in this matter with the following text: March 12, 2018: Deadline for Plaintiff to show cause or pay fees. January 23, 2018 Opinion or Order Filing 9 ORDER that Plaintiff's Motion for Leave to Proceed IFP (Filing No. 5 ), is granted. The filing fee shall be collected and remitted, as funds exist, in the manner set forth in 28 U.S.C. § 1915(b)(2). Until the full filing fee of $350 .00 is paid, the prisoner shall be obligated to pay, and the agency having custody of the prisoner shall forward to the clerk of the court, 20 percent of the preceding month's income in such months as the account exceeds $10.00. The cl erk of the court shall serve a copy of this order on the appropriate financial officer for Plaintiff's current institution. The next step in Plaintiff's case will be for the court to conduct an initial review of Plaintiff's claims to determine whether summary dismissal is appropriate under 28 U.S.C. § 1915(e)(2).
