ORDER Adopting 58 Report and Recommendation. FURTHER ORDERED that 46 Amended MOTION for Default Judgment is GRANTED. FURTHER ORDERED that Final Judgment is entered in favor of Mayweather and against the Wine Bistro and 2nd To None Entertainm ent, jointly and severally. FURTHER ORDERED that The Wine Bistro, 2nd To None Entertainment, their officers, agents, servants, employees, and attorneys, and other persons who are in active concert or participation with them, are permanently enjoined from using the Plaintiff's name and likeness for commercial gain. ORDER Granting in Part and Denying in Part 26 Emergency Motion to Extend Time for Service of Complaint and Summons Upon Defendant Zakee Boyd and 27 Emergency Motion to Extend Time for Service of Complaint and Summons Upon Defendant ZB Entert ainment, LLC. Mayweather is granted an additional 60 days from the expiration of the prior 120-day service period or until 12/7/2013 to serve Zakee Boyd and ZB Entertainment, LLC by personal service. The request to serve via email or publication is Denied. The Court's decision re 23 Emergency Motion to Extend Time for Service of Complaint and Summons Upon Defendant Maurice Flippen, 24 Emergency Motion to Extend Time for Service of Complaint and Summons Upon Defendant Anwar "War d" Jenkins, and 25 Emergency Motion to Extend Time for Service of Complaint and Summons Upon Defendant Leber Corp shall be deferred pending the court's review and consideration of supplemental materials. Mayweather shall supplement his motions with a good cause and/or excusable neglect demonstration as to Defendants Flippen, Jenkins, and Trio within 10 days of the date of this Order.
