ORDER that 1 Motion/Application for Leave to Proceed in forma pauperis is granted. The Clerk shall file the complaint. Plaintiff's claims of retaliation may proceed as to Defendant Luxor Resort and Casino. FURTHER ORDERED that Plaintiff' s claims of discrimination and harassment be dismissed without prejudice with leave to amend. Plaintiff shall have until November 2, 2017 to file an amended complaint correcting the noted deficiencies. FURTHER ORDERED that the Clerk of the Court shal l issue summons to Defendant, Luxor Resort and Casino, named in the Complaint and deliver the summons to the U.S. Marshal for service. The Clerk of the Court shall send the required USM-285 forms to Plaintiff. Plaintiff shall have twenty (20) days to furnish the required USM-285 forms to the U.S. Marshal. REPORT AND RECOMMENDATION that Plaintiff's claims against Defendants Shannon Fitzmyer, Sujoy Brahma, and Bill Miller be dismissed with prejudice for failure to state a claim upon which relief may be granted.
