December 15, 2020 Opinion or Order Filing 5 MINUTE ORDER IN CHAMBERS of the Honorable Judge Gloria M. Navarro on 12/15/2020. IT IS HEREBY ORDERED that Defendants Fidelity National Title Group, Inc., Chicago Title Insurance Company, and Ticor Title of Nevada, Inc. (collectively, "Defendants") show cause as to why the Court should not dismiss this action for failure to satisfy the diversity jurisdiction requirements set forth in 28 U.S.C. 1332. Specifically, Defendant states that the amount in controversy exceeds $75,000.00 because Plaintiff U.S. Bank ("Plaintiff") seeks to recover the $65,000.00 balance due on the loan, its attorney's fees in the underlying action, its attorney's fees in this action, and punitive damages. (See Pet. Removal 4:5-8, ECF No. 1). "Attorney's fees may be included in the amount in controversy if recoverable by statute or contract." Galt G/S v. JSS Scandinavia, 142 F.3d 1150, 1155-56 (9th Cir.1998). While the Policy, in this case, allows for recovery of attorney's fees, "the removing party must provide evidence establishing that it is 'more likely than not' that the amount in controversy exceeds that amount." Sanchez v. Monumental Life Ins. Co., 102 F.3d 398, 404 (9th Cir. 1996); see also Gaus v. Miles, Inc., 980 F.2d 564, 567 (9th Cir. 1992) (finding that removing party's allegation that "the matter in current controversy [...] exceeds the sum of $50,000" is insufficient to overcome the "strong presumption" against removal). Here, Defendants failed to allege specific attorney's fees to show that the amount in controversy exceeds $75,000.00. Accordingly, Defendants shall have until January 4, 2021, to file a brief, not to exceed ten pages, demonstrating that the Court has subject matter jurisdiction over this action. Failure to comply with this Order will result in this case being dismissed without prejudice.(Copies have been distributed pursuant to the NEF - NY) Modified to correct show cause response date on 12/15/2020 (EDS).
