August 3, 2010 Opinion or Order Filing 21 ORDER. IT IS ORDERED that Plaintiff's 5 Application to Proceed in Forma Pauerpis is GRANTED. Plaintiff shall not be required to pay an initial partial filing fee. However, even if this action is dismissed, the full filing fee must still be paid. FURTHER ORDERED, the NDOC shall pay to the Clerk of the USDC, District of NV, 20% of the preceding month's deposits to Plaintiff's account (inmate #96337), in the months that the account exceeds $10.00, until t he full $350 filing fee has been paid for this action. The Clerk shall send copy of this order to the Finance Division and to the Chief of Inmate Services for the NDOC. (Sent: 8/6/2010.) Failure to amend will result in the matter proceeding as to the counts allowed in this order. FURTHER ORDERED, all pending motions 4 , 7 , 8 , 12 , 16 , and 17 are DENIED as discussed herein.
