April 8, 2021 Opinion or Order ENDORSED ORDER granting #4 MOTION to Stay this Federal Habeas Proceeding. Text of Order: Petitioner Weston Stow has filed a petition for a writ of habeas corpus under 28 U.S.C. 2254, along with a motion seeking to stay this matter until the N.H. Supreme Court concludes its review of his appeal relating to the claims he has asserted in the petition. See Stow v. Warden, No. 2020-0925 (N.H.). The court grants the motion to stay (Doc. No. #4 ), finding good cause to hold in abeyance any further proceedings on this petition, including the court's screening of the petition under 28 U.S.C. 2243 and LR 4.3(d)(4), until that appeal is concluded, subject to the condition that Stow file a status report every sixty days, beginning on June 7, 2021, reporting on the status of that appeal. No later than thirty days after the N.H. Supreme Court issues a final decision in Stow v. Warden, No. 2020-0925 (N.H.), Stow is directed to file a motion to lift the stay in this case, attaching to that motion a copy of a final order in his appeal. If Stow fails to comply with the conditions specified in this Order, the court may lift the stay and dismiss the petition. So Ordered by Magistrate Judge Andrea K. Johnstone.
