ENDORSED ORDER. Text of Order: Plaintiff's recent filing, Doc. No. 11, consists of both an objection to defendant's motion to dismiss (9) and a proposed amended complaint. This violates LR 7.1(a)(1), which prohibits combining filings seeking separate and distinct relief. Giving deference to plaintiffs pro se status, the court will construe the filing as an objection to the motion to dismiss. The Clerk's office shall create a docket entry to reflect this construction. The plaintiff is cautioned, however, that any future filings which violate court rules will be returned to him. The court further construes ECF No. 13 as a motion to amend his complaint, which the court grants. The Clerk's office shall create a docket entry to reflect this construction. Pursuant to LR 15.1(c), defendant Keystone's motion to dismiss (9) is therefore denied without prejudice. Within 21 days, Keystone shall notify the court whether it wishes to renew and/or supplement its motion to dismiss. Any other defendant appearing in this case shall respond to the Amended Complaint in accordance with the Federal Rules.
