June 30, 2009 Opinion or Order Filing 74 REPORT AND RECOMMENDATION: Petitioner pro se brings this action pursuant to 28 U.S.C. § 2254 for a writ of habeas corpus. By order dated May 23, 2008, the Honorable Edward R. Korman, United States District Judge, referred this petition to me fo r a Report and Recommendation. Petitioner filed supplemental materials on July 31, 2008. For the reasons stated in the attached Report and Recommendation, I respectfully recommend that the petition for habeas corpus be denied. Objections to this r eport and recommendation must be filed within ten (10) days, with a courtesy copy to Judge Korman and to my chambers, in order to preserve appellate review. See 28 U.S.C. § 636(b)(1). Ordered by Magistrate Judge Robert M. Levy on 6/29/2009. (Marino, Janine)
