May 17, 2010 Opinion or Order Filing 33 ORDER: Plaintiff is hereby ordered to respond to defendant's discovery requests by June 17, 2010. This is a Court Order and plaintiff must comply. The deadline for the parties to complete all discovery is hereby extended to July 1, 20 10. Although plaintiff has not yet responded to defendant's discovery demands, defendant's counsel shall again notice plaintiff for his deposition on a date certain before 7/1/2010. The Court hereby warns plaintiff that should he fail t o respond to defendant's discovery demands and / or fails to attend his deposition in New York, the Court will recommend that this case should be dismissed. This is plaintiffs action to vindicate his rights. Moreover, plaintiff must respond to d efendant's discovery requests in order to proceed in this case. If plaintiff fails to respond to the outstanding discovery requests by 6/17/2010, defendant should write to request dismissal of the action under Fed. R. Civ. P. 37(b)(2)(A)(v). SO ORDERED. February 17, 2009 Opinion or Order Filing 2 MEMORANDUM AND ORDER: The complaint is dismissed as to New York Supreme Court pursuant to Fitzgerald v. First East Seventh Street Tenants Corp., 221 F.3d 362, 363-64 (2d Cir. 2000). Plaintiff is directed to show cause why the action sho uld not be dismissed for lack of subject-matter jurisdiction, setting forth the good faith basis for recovery of an excess of $75,000. All further proceedings shall be stayed for 30 days or until plaintiff has complied with this Order. If plaint iff fails to comply with this Order within the time allowed, the complaint shall be dismissed for lack of subject-matter jurisdiction. Fed. R. Civ. P. 12(h)(3). The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this Or der would not be taken in good faith and therefore in forma pauperis status is denied for purpose of an appeal.
