Filing 351 MEMORANDUM & ORDER: The Court GRANTS 331 Defendants' Motion for Summary Judgment, and, correspondingly, declines to address Plaintiffs' FRCP 56(d) cross-motion (Dkt. No. 336 ). For the reasons stated in this Memorandum & Order, the Court (i) DISMISSES Plaintiffs federal Lanham Act claim of trade dress infringement with prejudice and (ii) DISMISSES their related state-law claims without prejudice to be re-filed in state court.
